Agreement to Terms of Use

The Terms of Use govern access to and use of ESA Registration's website and services. Users agree to be bound by all terms by using the Services.

The Agreement has two parts: Part One explains governance of Service use, and Part Two contains additional legal terms including liability limitations and arbitration requirements.

Changes to Terms of Use

ESA Registration reserves the right to modify terms by posting amended versions on the Site. Any use of the Services after publication of changes constitutes acceptance of modified Terms.

Disputes arising before modifications are governed by the Terms in effect when the dispute occurred.

Eligibility

Users must be at least 18 years old. By using Services, users represent they:

• Have complied with eligibility requirements
• Are not restricted from using the Site
• Are not competitors of ESA Registration
• Will maintain only one account
• Have legal authority to enter the Agreement
• Will not violate rights of other users
• Will provide necessary equipment and internet access
• Agree to use their first name and email for registration

Part One: Terms Governing Use of the Site and Services

Emergencies

THIS SITE IS NOT AN EMERGENCY-RESPONSE OR EMERGENCY-MONITORING SERVICE. Individuals aware of emergencies should dial 911. ESA Registration has no obligation to monitor communications.

Age Limitations

The Site is intended for individuals 18 and above. Children under 13 are not permitted. Children 13–17 should seek parental permission. ESA Registration disclaims liability for use by individuals under 18.

Services and Information Are Not Professional Advice

Information provided is for general informational and educational purposes only and not intended as medical or professional advice. Users should consult qualified healthcare providers for specific medical questions and never disregard professional advice based on Site information.

While Services may connect users with mental health professionals ("Therapist"), communications are solely for exchanging information necessary for ESA Letters. No professional mental health or medical services may be provided using this Site.

Restricted Use

Users may only use the Site while obeying all applicable laws. Prohibited activities include:

• Violating any law
• Stalking, harassing, or harming others
• Collecting personal data about other users
• Impersonating individuals or entities
• Interfering with Site operations
• Attempting unauthorized access
• Reproducing or exploiting Site portions
• Using the Site for purposes other than intended
• Reverse engineering components
• Supporting SPAM transmission
• Using automated data gathering methods

Your Privacy

Users confirm they have accepted ESA Registration's Online Privacy Policy. Personal health information is not considered "protected health information" under the Health Insurance Portability and Accountability Act of 1996.

Ownership of Information Submitted

Except for personally identifiable health information maintained per Privacy Policy, all transmitted information will become the property of ESA Registration.

Registration

Registration may be required for certain Site features. Users must provide true, accurate, and complete information, including email address and password ("Credentials"). Users are responsible for maintaining Credentials confidentiality. Those suspecting unauthorized access should email support@esaregistration.org immediately.

Transactions

If purchasing products or services, ESA Registration requests applicable information including payment details. By providing information, users grant ESA Registration rights to share it with third parties for Transaction completion.

YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT MECHANISM USED IN CONNECTION WITH ANY TRANSACTION.

ESA Registration reserves rights to change descriptions, limit quantities, refuse service, and require verification. Pricing and availability are subject to change without notice. ESA Registration is not responsible for pricing or description errors.

Refunds and exchanges follow policies in effect at Transaction time. Current rates are available via support@esaregistration.org.

Promotions

Prize draws and similar promotions may have separate rules. Participation subjects users to those specific rules. Users should review applicable rules and the Privacy Policy, which govern submitted information. If rules conflict with Terms, rules prevail.

Social Media and Online Communities

ESA Registration provides opportunities to share information on Social Media Sites and participate in online communities. Users may submit Tagged Content with provided hashtags.

Users grant ESA Registration a perpetual, worldwide, royalty-free, transferable, and sub-licensable right and license to use, copy, distribute, modify, create joint and derivative works of your content, postings, and Tagged Content in any form or format.

Users agree not to:

• Post libelous, defamatory, false, obscene, indecent, violent, abusive, threatening, harassing, discriminatory, or hate speech material
• Upload materials without copyright or permission
• Violate third-party rights
• Post materials not owned or in public domain
• Create or upload software with viruses or harmful code
• Solicit users or distribute advertising
• Gather email addresses for bulk messaging
• Share personally identifying information
• Post material violating laws
• Impersonate others
• Post untruthful experiences

Monitoring

ESA Registration has no obligation to monitor materials but reserves rights to monitor, alter, remove, or disclose materials and transmission circumstances to third parties to operate the Site properly, protect itself and users, and comply with legal obligations.

Copyright Notice

The Site and contents are protected by U.S. and international copyright law. ESA Registration and licensors retain all proprietary rights.

Users may not copy, republish, upload, post, display, transmit, or frame materials without written consent. Users may link to, view, download, use, display, and print single copies for personal, noncommercial, informational purposes.

Copyright Infringement — DMCA Notice

The Digital Millennium Copyright Act provides remedies for copyright holders. Those believing content infringes valid copyrights may send notices to: support@esaregistration.org or ESA Registration, 232 E 2nd St, Unit A #8136, Los Angeles, CA 90012.

Notices must include:

• Physical or electronic signature of authorized person
• Identification of copyrighted work
• Identification of allegedly infringing material
• Name, address, telephone, and email of complaining party
• Statement that use is not authorized
• Statement that information is accurate and complaining party is authorized

Trademark Notice

ESA Registration names, logos, and related marks are trademarks. All rights are reserved. Users cannot use ESA Registration names or marks in advertisements or commercial manner without written consent.

Security

ESA Registration has implemented technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, unauthorized third-party access cannot be guaranteed.

Part Two: Additional Legal Terms

No Warranties

USE OF THIS SITE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

ESA Registration does not warrant content accuracy, Site availability, error correction, or virus-free operation. Any content downloaded or otherwise obtained through the use of this Site is downloaded at your own risk.

Indemnity

BY VISITING THIS SITE, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ESA REGISTRATION and affiliated entities, officers, directors, employees, contractors, agents, and representatives from all claims, actions, demands, liabilities, judgments, settlements, costs, losses, damages, and expenses arising from Site use.

Limitation of Liability and Damages

THE USER'S SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND ANY OF ITS SERVICE IS TO STOP USING THE SITE OR SERVICE. No ESA Registration Party is liable for damages from Site use or inability to use. This covers warranty, contract, and tort claims. This protection covers all losses and claims of any type including, without limitation, direct or indirect, special, incidental, reliance, consequential, exemplary, and punitive damages.

Binding Individual Arbitration

You and ESA Registration agree to arbitrate all Disputes. Arbitration is more informal than a lawsuit in court and seeks to resolve disputes more quickly.

ANY ARBITRATION UNDER THIS AGREEMENT WILL ONLY BE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS, CLASS ACTIONS, PRIVATE ATTORNEY GENERAL ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED.

Users waive jury trial rights and class action participation. All Disputes are resolved finally and exclusively by binding individual arbitration with a single arbitrator administered by the American Arbitration Association.

Consumer claimants may pursue claims in local small-claims court. The Federal Arbitration Act applies. Consumer arbitration hearings occur in users' counties; otherwise in Los Angeles, California, or mutually agreed locations.

Jurisdiction

The Agreement is governed by California law, exclusive of choice of law provisions. Site use outside California is prohibited where laws would void the Agreement in essential part.

Limitation on Time to Initiate a Dispute

Actions relating to disputes must commence within one year after the cause of action accrues.

Electronic Communications

Users consent to receiving electronic communications from ESA Registration regarding fees, charges, transactional information, and Service-related matters. Any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements.

Therapist communications occur via phone, email, text, online chat, and video. Users consent to receiving Therapist communications. Email, text, and chat are not encrypted; users should not share sensitive information through these methods.

Severability

If provisions are held unenforceable, they shall be eliminated to minimum extent necessary for the remainder to retain full force and effect.

Entire Agreement

The Agreement constitutes the entire agreement applicable to its subject matter. It may be modified only as described elsewhere. Translations are provided for convenience; English versions govern the relationship.
